Termsofservice.
This agreement
These terms are between you and [Stillwell legal entity name], [registered address] (“Stillwell”, “we”, “us”). By creating an account, leaving a tribute, or ordering from us, you agree to them. If you do not agree, please do not use Stillwell.
What Stillwell is
Stillwell lets you create a remembrance — a lasting page for someone’s life — and gather the stories, photographs, letters and recordings that belong to it. We also make engraved plaques that connect to a remembrance through a QR code. Creating a remembrance is free; plaques and keepsakes are sold.
Your account
You must be 18 or over to create an account. Keep your sign-in details to yourself; you are responsible for what happens under your account. Tell us straight away if you think someone else has used it.
What you add
What you add to Stillwell stays yours. You give us permission to store it, copy it as needed to keep it safe, and show it to the people you have chosen — only so that we can provide Stillwell to you. That permission ends when you delete it, except for copies we must keep for a short time in backups or by law.
Only add what you have the right to share. Be thoughtful about living people you mention, and about photographs and recordings of them.
Tributes and care
Stillwell is a place for remembering. Please do not add or leave anything that is unlawful, hateful, harassing, or that intrudes on someone’s grief. The people who keep a remembrance can remove any tribute on it, and we may remove anything that breaks these terms and, if needed, close the account behind it.
If you see something that should not be on Stillwell, write to [email protected].
Plaques and orders
When you order a plaque, we will confirm the engraving with you before it is made. Because each plaque is engraved for one person, we cannot accept a return once it is made, unless it arrives damaged or differs from what you confirmed — in which case we will replace it.
Please check your cemetery’s rules before ordering; some limit what may be fixed to a headstone. Prices, delivery times and any other terms of an order are shown before you pay [details to confirm].
Keeping remembrances online
Remembrances are meant to outlast us. A portion of every purchase supports an independent non-profit foundation whose purpose is to keep Stillwell remembrances online for generations, independent of any single company [structure and commitments to confirm].
Availability
We work to keep Stillwell available and your remembrances safe, but we cannot promise it will never be interrupted. We may change or improve Stillwell over time; if a change takes something important away from you, we will tell you in advance.
Leaving Stillwell
You can close your account at any time, and take a copy of your remembrances with you. We may suspend or close an account that seriously or repeatedly breaks these terms, and will tell you why.
Our responsibility to you
Nothing in these terms limits responsibility that the law does not allow to be limited. Otherwise, [limitation of liability to be drafted by counsel].
Governing law
These terms are governed by the laws of [the State of New York], and disputes will be heard in its courts, unless the law where you live gives you the right to bring them there.
Changes to these terms
If we change these terms in a way that matters, we will tell you by email before the change takes effect.
